By accessing or using AzanCast (“the service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the service. If you are using the service on behalf of an organization (such as a mosque), you represent that you have the authority to bind that organization to these terms.

Features and availability may change over time as we improve the service.
You must create an account to use AzanCast. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date.
You must notify us immediately at azancast@gmail.com if you suspect unauthorized access to your account.
AzanCast offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:
AzanCast offers mosques the ability to accept online donations from their congregation through Stripe Connect. The following terms apply to any mosque that enables donations and to any donor who contributes through a mosque's donation page:
When a donor makes a contribution through a mosque's donation page, the receiving mosque is the merchant of record for that transaction. AzanCast acts solely as a technology platform that facilitates the payment via Stripe Connect. The legal, contractual, and tax relationship for the donation is between the donor and the mosque, not between the donor and AzanCast.
AzanCast is not a tax-exempt organization and does not provide tax advice. Whether a donation is tax-deductible depends entirely on the receiving mosque's own tax-exempt status (such as 501(c)(3) in the United States or equivalent in other jurisdictions). Mosques are solely responsible for confirming their own tax-exempt status, providing accurate organization information (including any EIN or legal name displayed on receipts), and complying with all applicable tax laws. Receipts generated by the AzanCast platform are not, by themselves, evidence of tax-deductibility. Donors should consult their own tax advisor.
AzanCast charges a small platform fee on each donation processed through the service (currently 5% on the Free plan and 2% on the Pro plan, in addition to standard Stripe processing fees). Fees may change with at least 30 days' notice to active mosques. The exact fee for a transaction is shown to the donor at checkout.
Refund decisions for donations are the responsibility of the receiving mosque. AzanCast will not initiate refunds on a mosque's behalf without instruction. If a donor disputes a charge or initiates a chargeback through their card issuer, the chargeback amount and any associated fees will be deducted from the receiving mosque's Stripe Connect balance, in accordance with Stripe's Connected Account Agreement. AzanCast is not liable for chargebacks, refunds, or other payment disputes between donors and mosques.
When a donor contributes through a mosque's donation page, limited donor information (name, email, donation amount, and recurrence preferences) is shared with that mosque so the mosque can manage its donor relationships, send receipts, and comply with applicable record-keeping requirements. By making a donation, donors consent to this sharing. Mosques are responsible for handling donor information in accordance with applicable privacy laws (including GDPR for donors located in the European Economic Area) and for using donor information only for purposes reasonably related to managing their donor relationships. Mosques must not sell, rent, or share donor information with unrelated third parties.
To accept donations through AzanCast, a mosque must complete Stripe Connect's identity verification (KYC) process. Stripe may require business documentation, identity verification, and bank account information directly from the mosque. AzanCast does not store or have access to this verification data. Mosques must accurately represent themselves and not use the donation feature for unlawful purposes, fraudulent solicitation, or money laundering.
AzanCast reserves the right to suspend or disable the donation feature for any mosque that we reasonably believe is engaged in fraud, misrepresentation, or any conduct that violates these terms or Stripe's policies. Stripe may also independently suspend or restrict a mosque's Connected Account; in such cases, AzanCast cannot override Stripe's decision and is not liable for any resulting interruption in donations or access to funds.
In addition to the general limitation of liability in Section 12, AzanCast is not liable for: (a) any donation that is delayed, lost, or fails to reach a mosque due to Stripe outages, banking errors, or third-party service interruptions; (b) any tax consequences for donors or mosques; (c) any disputes between donors and mosques regarding the use of donated funds; or (d) any decision by Stripe to hold, freeze, or return funds.

Prayer times are calculated using established Islamic astronomical algorithms. While we strive for accuracy, times may vary slightly from your local mosque or other sources depending on the calculation method and parameters used. AzanCast should not be relied upon as the sole source of prayer time information. We are not responsible for any consequences of relying on the prayer times provided by the service.
We aim to provide reliable service but cannot guarantee uninterrupted or error-free availability. The service depends on third-party platforms (Amazon Alexa, Supabase, Vercel, Stripe) that may experience downtime. We may perform scheduled maintenance that temporarily affects availability. We are not liable for missed adhan notifications, display outages, or any other service interruptions.
The AzanCast name, logo, website design, display layouts, and software are the property of AzanCast and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the service without our written consent.
Some adhan audio files are sourced from publicly available recordings. Certain audio content is proprietary to AzanCast and may not be downloaded, redistributed, or used outside of the service.
Content you provide (such as mosque names, settings, and preferences) remains yours. By using the service, you grant us a limited license to use this content solely to operate and provide the service to you.
AzanCast respects intellectual property rights and expects users to do the same. If you believe that content displayed through the service (including announcements, media slides, sponsor images, uploaded logos, or any other user-submitted content) infringes your copyright, please send a notice that includes the following information to azancast@gmail.com:
Upon receiving a valid notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted it. Repeat infringers may have their accounts terminated. The party who posted the content may submit a counter-notice if they believe the removal was a mistake or misidentification. We follow the notice-and-takedown procedures described in the United States Digital Millennium Copyright Act (DMCA) and equivalent procedures under the EU Digital Services Act (DSA).
To the maximum extent permitted by applicable law, AzanCast is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall AzanCast, its owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of or inability to use the service.
Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to AzanCast in the 12 months preceding the claim, or $100 USD, whichever is greater.
You agree to indemnify and hold harmless AzanCast and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your violation of these terms, or your violation of any rights of a third party.
You may stop using the service at any time by disabling the Alexa skill and/or deleting your account. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice. Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.
These terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles. Any disputes arising from these terms or the service shall be resolved in the courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.
Before filing any formal legal action, you agree to attempt to resolve disputes informally by contacting us at azancast@gmail.com. We will try to resolve the matter within 30 days.
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 15 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree with the changes, you must stop using the service.
